We
have been advising clients on major public-private partnership
projects for many years and have been involved in pfi since its
inception. We acted for Galliford Try on the
first grouped schools project to close in England and PFI and PPP continue to be a major strength of the firm.
We
have the experience, expertise and depth of resource to advise
on the most challenging pfi/ppp projects. We are currently
advising on many innovative projects. In 2005 Legal 500 described us as having "a well-respected PFI practice".
The
levering in of private sector resource and funding to the provision
of public services is here to stay. New models of procurement
are emerging and with our extensive experience we are well placed
to advise any interested party in such a transaction.
Our
lawyers have advised public bodies, private sector bid consortia
and subcontractors and funders in all major sectors in which
public private partnerships are utilised including, transport,
schools, HE and FE accommodation, street
lighting, health, waste and defence.
Our
projects team works particularly closely with our construction, procurement, education and energy teams
but also draws on the wide range of specialist lawyers within
the firm, including property, planning, charities & trusts,
construction, employment and pensions.
Whilst
we have a broad range of skills and expertise, our particular
areas of expertise are as follows:
Procurement
As
well as having detailed knowledge of EU
Law relating to public procurement, and its practical application
we have extensive experience of advising public bodies on how
to structure the procurement process to avoid legal challenge,
generate maximum competition and deliver the best result, and
of advising bid consortia on how to optimise their chance of success.
This experience places us in a unique
position in advising both procuring authorities and bid consortia.
Education
Our lawyers
have undertaken numerous schools PFI projects acting for local
education authorities, contractors, funders and
school governors. In addition we are currently engaged on several
innovative and exciting developments for our HE and FE clients
involving teaching facilities, student accommodation and a library.
Private sector involvement in this sector is set to increase
significantly and we are uniquely placed to advise on such projects
not only because of our significant projects capability but also
through our thorough understanding of the sector which is advised by our
nationally acclaimed Education practice.
Transport
We
acted for Centro in relation to the Midland Metro Line 1 and
are currently assisting them in devising their procurement strategy
for lines 2 and 3 extensions, involving a line running through
the city centre and a line running to the Merry Hill Shopping Centre in Dudley.
Street Lighting
Members
of our projects team have advised clients on a number of street
lighting PFI projects, including the consortium and its funder
successfully bidding for the Staffordshire Street Lighting PFI
project.
Health
We
are advising clients in relation to hospital PFI projects and
have advised in relation to medical equipment PFI projects.
Waste
Our
lawyers have advised on a number of waste management PFI projects,
including advising the local authority on an integrated refuse
collection and waste management project, which is now in the
operational stage.
Defence
Our
lawyers have advised in relation to accommodation projects and
in relation to innovative and extremely complex battlefield equipment
PFI projects.
