Water and Sewerage
Our
clients include statutory undertakers, an industry regulator
and many large water users. We have represented clients in the
water sector for many years, and acted on one of the first conversions
of a statutory water company to a listed plc following privatisation
of the industry in 1989.
Our
experience and expertise includes advising:
- across the spectrum of water sector regulation,
including the Water Industry
Act 1991 and the Water Resources Act 1991, instruments of appointment,
charges schemes, codes of practice and abstraction licensing
- on the application of EU and UK competition law
to the water and sewerage sector, including the inset appointment
regime and the licensing of new water suppliers to retail water
or input water into existing water suppliers’ networks
(common carriage and retail/wholesale supply competition)
- on
water supply issues such as bulk supply contracts,
terms of statutory supply, pricing (including metering issues
and discrimination), disconnection rights and duties,
statutory powers of access and pipe-laying, fluoridation and
the
rules relating to private supplies
- on water resource issues including hosepipe bans
and drought orders
- on charitable trusts established by water companies to assist
those unable to meet water bills (we set up the very first
in the industry)
- on the sale of one of the few tidal rivers in the UK in private
ownership
- on agreements for bulk supply and terms of supply for large
users
- on terms for sewerage services including trade effluent agreements
- on capital
projects for the construction, operation and transfer of sewerage
treatment facilities on a PFI basis
- on environmental regulation and operational compliance, including
the implementation of the Water Framework Directive
- on environmental issues in the water industry, corporate and lending
transactions, and
- on
outsourcing agreements (eg for customer call centres)
We
continue to advise on proposals for reform in the industry, including
the implementation
of the new common carriage and retail/wholesale water supply
regime introduced by the Water Act 2003.
